Who is affected by the Whistleblower law?

The Whistleblower Act, once it enters into force, will force a wide range of actors to implement appropriate solutions and regulations.

Among the obliged institutions will be:

  • Managers of Alternative Investment Funds (AIFM),
  • Payment institutions,
  • Insurance intermediaries,
  • Other financial institutions,
    Entities that employ at least 50 persons regardless of the basis of employment,
  • Districts and municipalities with more than 10 000 inhabitants.

A whistleblower is a person who, on the basis of information in their possession, reports irregularities that they have noticed. Whistleblower status is awarded to a person who, on the basis of facts and in the public interest, reports irregularities of various kinds in a company or public institution.

The purpose of the creation of this directive, and of systems such as Incognitee, is to ensure the safety of whistleblowers from retaliation by employers. The Directive defines who is protected and how they are protected, and how a whistleblower can report violations in the institution or company they work for.

Work on the law has been ongoing for many years. On 19 June 2024, the President signed the Law of 14 June 2024 on the protection of whistleblowers. The law will enter into force three months after its promulgation, i.e. on 25 September 2024.
